Ombudsman of the Verkhovna Rada for Human Rights Lyudmyla Denisova has addressed Speaker of the Parliament Dmytro Razumkov with an official letter, in which she notes the inconsistencies with the Constitution of Ukraine of draft law No.5599 "On the prevention of threats to national security associated with the excessive influence of persons with significant economic or political heft in public life (oligarchs)", - Interfax.Ukraine reported.
"The results of our analysis of the draft law's provisions cause concern, since they allow us to conclude that its norms do not comply with the Constitution of Ukraine, and their implementation will lead to violations of human and civil rights and freedoms", - the letter says.
The list of such norms includes granting of the president and the NSDC of powers unforeseen by the Constitution of Ukraine, restrictions on human rights depending on property status, indirect introduction of censorship in the media and the like.
"In my opinion, in order to ensure the observance of the rights and freedoms of citizens and prevent their violations when adopting this legislative initiative, it is necessary to send it for receiving the conclusion of the European Commission "For democracy through law" (Venice Commission) before its consideration in the second reading", - Denisova suggests.
The Ombudsman notes that the adoption of the law on oligarchs in the current wording will lead to its consideration in the Constitutional Court.
"If this draft law is adopted in the first reading version, I will be forced to make a constitutional submission to the Constitutional Court of Ukraine regarding the resolution of the issue of compliance with the Constitution of Ukraine (constitutionality) of such a law in accordance with Article 15 of the Law of Ukraine "On the Commissioner of the Verkhovna Rada for Human Rights", - she notes.
As reported, the Verkhovna Rada adopted bill No.5599 as a basis at an extraordinary meeting on July 1 with 275 votes.
