President of Ukraine Volodymyr Zelenskyy has introduced a bill to the Verkhovna Rada, which proposes to terminate the powers of current composition of the Constitutional Court and immediately start selecting new candidates. The draft law, entitled "On the restoration of public confidence in constitutional proceedings" has already been posted on the Verkhovna Rada's website.
It proposes to recognize that the decision of the Constitutional Court of October 27, 2020 is null and void, since it was made by the judges of the Constitutional Court in conditions of a real conflict of interest.
The draft law assumes that the powers of the Constitutional Court of Ukraine, which was in force at the time of adoption of the above-mentioned decision, terminate from the date of entry into force of this law.
"The subjects of the appointment of judges of the Constitutional Court of Ukraine to immediately begin the selection procedure by means of competition, followed by the appointment of a new composition of the Constitutional Court of Ukraine, in the manner prescribed by the Constitution of Ukraine and the Law of Ukraine "On the Constitutional Court of Ukraine", - the bill notes.
It also says that the "Law of Ukraine "On the Prevention of Corruption" and the relevant article of the Criminal Code are valid in the version that was in force before the adoption by the Constitutional Court of Ukraine of the decision of October 27, 2020
As previously reported, it became known on October 27 that the Constitutional Court had recognized certain provisions of anti-corruption legislation unconstitutional. In pursuance of this decision, the NABU closes the register of electronic declarations since October 28. The NABU reported that 110 cases would have to be closed due to the decision of the Constitutional Court. The NABU announced on October 29 that the Constitutional Court had actually blocked the appointment of leading personnel of the authorities, including the local elections' winners, by its decision to close the Register of income declaration.
At the same time, the investigation of the Schemes program (a project of Radio Liberty and the UA: Pershyi TV channel) showed that head of the Constitutional Court of Ukraine Oleksandr Tupytskyi did not declare the land property in the Crimea, the owner of which he became after the annexation of the peninsula.
